It's kind of like the religious colleges. Certain religious colleges say in their rule book that homosexuality, or even the belief that homosexuality is acceptable/tolerable will lead to expulsion.  
Are these schools within their "rights"? I think they are.  
I am a Christian, so I would in fact consider going to a religious school. I also identify as gay. This restricts me, as the choices are greatly narrowed to pro-gay options.  
The schools do have that right, should they so choose. If it is their religious opinion that homosexuality is wrong, they have the right to not allow gays. Same concept with the Boy Scouts. Now, anything state-run is totally different. But private schools or organizations have different rules than state run things.  
This isn't to say that the Boy Scouts are acting in a respectable manner. But they are not acting in an illegal manner.

I know the marriage issue is hot, but I don't understand what your teacher meant that gays can't date because they can't get married. Plenty of couples date without the intention of ever getting married. That logic doesn't make sense to me.
